(<DefinedTermFr>évaluation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="495390" lims:id="495390" generate-in-text="no"><Text><DefinedTermEn>base factor</DefinedTermEn>, in respect of water services or sewer services, means the numerical value assigned to a unit each year by a council or committee of residents of a park and representatives of Parks Canada for purposes of determining the owner’s share of recoverable capital costs incurred in respect of the park to deliver water services or sewer services, as the case may be, to lots in the park; (<DefinedTermFr>facteur de base</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="495391" lims:id="495391" generate-in-text="no"><Text><DefinedTermEn>business</DefinedTermEn> includes any trade, calling, industry, employment or occupation carried on for gain or profit in a park; (<DefinedTermFr>commerce</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="495392" lims:id="495392" generate-in-text="no"><Text><DefinedTermEn>dwelling unit</DefinedTermEn> means two or more rooms used or intended for use as a single domestic housekeeping unit with cooking, living, sleeping and sanitary facilities; lims:id="495418"><Label>3</Label><Subsection lims:inforce-start-date="2010-06-17" lims:fid="495419" lims:id="495419"><Label>(1)</Label><Text>Subject to sections 4 and 11.1, the owner of every building on a lot that fronts or abuts on any part of a street on which a water main or sewer main has been laid shall connect the building directly to that water main or sewer main, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2010-06-17" lims:fid="495420" lims:id="495420"><Label>(2)</Label><Text>Subsection (1) does not apply to a garage, detached structure designed to provide accommodation for tourists or any other building on a lot that is appurtenant to, and designed to improve the usefulness and convenience of, a building on a lot that is connected lims:inforce-start-date="2018-11-23" lims:fid="495427" lims:id="495427"><Label>(b)</Label><Text>make any connection with a water pipe connected to a water main, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495428" lims:id="495428"><Label>(c)</Label><Text>make any connection with a sewer pipe connected to a sewer main,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2018-11-23" lims:fid="495429" lims:id="495429"><Text>without the permission in writing of the superintendent.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495430" lims:id="495430"><Label>(2)</Label><Text>The superintendent is authorized to grant the permission after taking into consideration</Text><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495431" lims:id="495431"><Label>(a)</Label><Text>the capacity of the park’s sewer and water systems;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495432" lims:id="495432"><Label>(b)</Label><Text>any technical or material constraints;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495433" lims:id="495433"><Label>(c)</Label><Text>the preservation of the park’s natural resources and the protection of its cultural, historical and archaeological resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495434" lims:id="495434"><Label>(d)</Label><Text>the safety, health and enjoyment of persons who are visiting or residing in the park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495435" lims:id="495435"><Label>(e)</Label><Text>the preservation, control and management of the park.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:id="495451"><Label>(a)</Label><Text>tamper with or damage any structure or appliance forming part of the sewer system in a park; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495452" lims:id="495452"><Label>(b)</Label><Text>deposit refuse or other matter into any pipe, fixture, manhole or other appurtenance of the sewer system lims:fid="495455" lims:id="495455"><Label>8</Label><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495456" lims:id="495456"><Label>(1)</Label><Text>No person shall construct or maintain any well in a park, for the supply of water for his own use, or the use of any other person, without the permission in writing of the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495457" lims:id="495457"><Label>(2)</Label><Text>The superintendent is authorized to grant permission for the construction or maintenance of a well in a park if the water drawn from the well is to be used for geothermal purposes or if the park has no water system to which a connection can be lims:id="495460"><Label>9</Label><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495461" lims:id="495461"><Label>(1)</Label><Text>No person shall install a septic tank or dry privy in a park without the permission in writing of the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495462" lims:id="495462"><Label>(2)</Label><Text>No person shall install a sewer in a park that is not to be connected to the sewer system in that park without the permission in writing of the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495463" lims:id="495463"><Label>(3)</Label><Text>An application for permission to install a septic tank or a sewer that is not to be connected to the sewer system in a park shall be accompanied by</Text><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495464" lims:id="495464"><Label>(a)</Label><Text>plans and specifications of the proposed septic tank or sewer, including an estimate of the cost thereof; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495465" lims:id="495465"><Label>(b)</Label><Text>a fee of $1 for each $1,000 or fraction thereof of the cost of such septic tank or sewer as stated in the estimate referred to in paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="495466" lims:id="495466"><Label>(4)</Label><Text>The superintendent is authorized to grant permission for the installation of a septic tank, dry privy or sewer in a park if the park has no sewer system to which a connection can be made, after taking into consideration</Text><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495467" lims:id="495467"><Label>(a)</Label><Text>the capacity of the park’s sewer and water distribution systems;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495468" lims:id="495468"><Label>(b)</Label><Text>any technical or material constraints;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495469" lims:id="495469"><Label>(c)</Label><Text>the preservation of the park’s natural resources and the protection of its cultural, historical and archaeological resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495470" lims:id="495470"><Label>(d)</Label><Text>the safety, health and enjoyment of persons who are visiting or residing in the park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="495471" lims:id="495471"><Label>(e)</Label><Text>the preservation, control and management of the level="1"><TitleText>Connections to Water Main and Sewer Main</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495475" lims:id="495475"><Label>10</Label><Text>Each application for the making of a connection to a water main or sewer main in a park shall be made to the superintendent on a prescribed form obtainable from the superintendent and shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495476" lims:id="495476"><Label>(a)</Label><Text>be signed by the owner of the lot in respect of which the application is made or his agent authorized in writing for the purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495477" lims:id="495477"><Label>(b)</Label><Text>state the type of premises in respect of which the water is to be used or the sewer connected; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495478" lims:id="495478"><Label>(c)</Label><Text>state the number of rooms or the floor area of any building in respect of which the water is to be used or the sewer connected, where these are factors in establishing the water or sewer rate payable.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495481" lims:id="495481"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495482" lims:id="495482"><Label>(1)</Label><Text>The owner of a building who is required pursuant to subsection 3(1) to connect his building to a water main or sewer main shall pay</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495483" lims:id="495483"><Label>(a)</Label><Text>all the costs for the construction of that part of the connection that is within his lot line; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495484" lims:id="495484"><Label>(b)</Label><Text>the extra costs for the construction of that part of the connection that is outside his lot line that arise because of the presence of rock, frost or other obstacles or because of the removal and replacement during the construction of any portion of a street, sidewalk or boulevard.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495485" lims:id="495485"><Label>(2)</Label><Text>On receiving an application made in accordance with section 10 and receiving a security deposit from the applicant in the form of a certified cheque or cash deposit in an amount equal to the portion of the estimated cost of construction for which the owner is responsible under subsection (1), the superintendent shall cause the connection to be made and any soil or portion of a street, sidewalk or boulevard that was removed for the making of the connection to be replaced.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495486" lims:id="495486"><Label>(3)</Label><Text>On completion of a connection to a water main or sewer main, the superintendent shall prepare a statement setting out the portion of the actual costs for which the owner is responsible and shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495487" lims:id="495487"><Label>(a)</Label><Text>where the amount of the security deposit referred to in subsection (2) exceeds the portion of the actual costs for which the owner is responsible, deposit that portion to the credit of the Receiver General and refund the balance to the owner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495488" lims:id="495488"><Label>(b)</Label><Text>where the amount of the security deposit referred to in subsection (2) is equal to or less than the portion of the actual costs for which the owner is responsible, deposit that portion to the credit of the Receiver General and notify the owner of the amount of the balance, if any, of the portion lims:id="495491"><Label>11.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495492" lims:id="495492"><Label>(1)</Label><Text>Where an additional building is erected on a lot on which there is another building already connected to a water main or sewer main or where an existing building on a lot is altered, the owner of the building shall apply to the superintendent for permission to make an additional connection or to alter an existing connection.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495493" lims:id="495493"><Label>(2)</Label><Text>On approving an application made pursuant to subsection (1) and receiving from the applicant a security deposit in the form of a certified cheque or cash deposit in an amount equal to the estimated cost of the construction for which the owner of the building is responsible under section 11.2, the superintendent may prescribe terms respecting</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495494" lims:id="495494"><Label>(a)</Label><Text>the location of the connection to a previously installed connection or to a water main or sewer main;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495495" lims:id="495495"><Label>(b)</Label><Text>the manner in which the connection is to be constructed, including</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="495496" lims:id="495496"><Label>(i)</Label><Text>the grade, type and size of pipe;</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="495497" lims:id="495497"><Label>(ii)</Label><Text>the quality and extent of pipe bedding; and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="495498" lims:id="495498"><Label>(iii)</Label><Text>the quality and extent of pipe trench backfill material.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495499" lims:id="495499"><Label>(3)</Label><Text>Where the owner of a building does not comply with any terms prescribed by the superintendent pursuant to subsection (2), the superintendent may cause the connection to be made in accordance with the terms.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495500" lims:id="495500"><Label>(4)</Label><Text>The owner of the building may enter into an agreement with the superintendent permitting the superintendent to cause the connection to a water main or sewer main to be made.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495501" lims:id="495501"><Label>(5)</Label><Text>On completion of a connection to a water main or sewer main made pursuant to subsection (3) or (4), the superintendent shall prepare a statement setting out the costs for which the owner is responsible under section 11.2 and shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495502" lims:id="495502"><Label>(a)</Label><Text>where the amount of the security deposit referred to in subsection (2) exceeds the costs for which the owner is responsible, deposit that amount to the credit of the Receiver General and refund the balance to the owner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495503" lims:id="495503"><Label>(b)</Label><Text>where the amount of the security deposit referred to in subsection (2) is equal to or less than the costs for which the owner is responsible, deposit that amount to the credit of the Receiver General and notify the owner of the amount of the balance, if lims:fid="495506" lims:id="495506"><Label>11.2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495507" lims:id="495507"><Label>(1)</Label><Text>Where a connection is made pursuant to subsection 11.1(1) or (3), the owner of the building shall pay the costs</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495508" lims:id="495508"><Label>(a)</Label><Text>if he is erecting an additional building, of connecting that bulding to the existing connection to the water main or sewer main at a point within his lot line; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495509" lims:id="495509"><Label>(b)</Label><Text>if he is erecting an additional building or altering an existing building and the existing connection is inadequate in size or so located as to be unsuitable for the additional building or altered bulding, of connecting the building to the water or sewer main at a point outside his lot line.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495510" lims:id="495510"><Label>(2)</Label><Text>In addition to the costs payable under subsection (1), the owner of a building shall pay the extra costs for the construction of that part of the connection that is outside his lot line that arise because of the presence of rock, frost or other obstacles or because of the removal and replacement during the construction of any portion of a street, sidewalk or boulevard.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem owner of a building pursuant to section 11 or 11.2 is the property of Her Majesty the Queen in right of Canada.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" superintendent may at any reasonable time enter any lot or building in respect of which a water or sewer connection has been made to examine the plumbing, drain and vent piping and to ascertain the amount of water used and the manner of use.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495518" lims:id="495518"><Label>(2)</Label><Text>The superintendent may, with the permission of the owner or occupant, enter any lot or building for the purpose of installing a water meter.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem Supply</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="495522" lims:id="495522"><Label>13</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495523" lims:id="495523"><Label>(1)</Label><Text>The superintendent may shut off the water supply in respect of any lot or building where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495524" lims:id="495524"><Label>(a)</Label><Text>any fixture or appliance is causing a wastage of water;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495525" lims:id="495525"><Label>(b)</Label><Text>a water fixture has been installed or connection made without his approval; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495526" lims:id="495526"><Label>(c)</Label><Text>water or sewer charges have not been paid within 30 days after the due date for payment thereof.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495527" lims:id="495527"><Label>(2)</Label><Text>Where any water is shut off pursuant to subsection (1) it shall not be turned on again until the fixture, appliance or connection has been removed, repaired or replaced to the satisfaction of the superintendent or the charges where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495531" lims:id="495531"><Label>(a)</Label><Text>it is expedient to repair, replace or install any water main or other work; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495532" lims:id="495532"><Label>(b)</Label><Text>there is a conflagration or other circumstance that, in the opinion of level="1"><TitleText>Applicable Charges for Water and Sewerage</TitleText></Heading><Section lims:inforce-start-date="2010-06-17" lims:lastAmendedDate="2010-06-17" lims:fid="495536" lims:id="495536"><Label>15</Label><Subsection lims:inforce-start-date="2010-06-17" lims:fid="495537" lims:id="495537"><Label>(1)</Label><Text>Every owner of a lot located in Kootenay National Park of Canada or Fundy National Park of Canada shall</Text><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495538" lims:id="495538"><Label>(a)</Label><Text>inform the superintendent of that park of the number of rooms — excluding any halls, vestibules, bathrooms, pantries or closets — the floor area of those rooms and the use of any buildings on the lot for the purposes of determining the annual quantity charge for water or sewerage payable by the owner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495539" lims:id="495539"><Label>(b)</Label><Text>if the lot is connected to the park water system, pay an annual quantity charge for water at the rate set out in Schedule IV or VIII, as the case may be.</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495540" lims:id="495540"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/2010-140, s. 8]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-06-17" lims:fid="495541" lims:id="495541"><Label>(2)</Label><Text>Every owner of a lot located in Kootenay National Park of Canada shall</Text><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495542" lims:id="495542"><Label>(a)</Label><Text>if the lot is connected to the park water or sewer system, pay an annual service connection charge at the rate set out in Schedule IV;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495543" lims:id="495543"><Label>(a.1)</Label><Text>if the lot is connected to the park sewer system, pay an annual quantity charge for the sewer at the rate set out in Schedule IV; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495544" lims:id="495544"><Label>(b)</Label><Text>if the lot is connected to the park water or sewer system and the lot fronts or abuts on a street along which a water main or sewer main has been laid, pay</Text><Subparagraph lims:inforce-start-date="2010-06-17" lims:fid="495545" lims:id="495545"><Label>(i)</Label><Text>an annual general assessment charge, based on the assessed value of the lot, at the rate set out in Schedule IV, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2010-06-17" lims:fid="495546" lims:id="495546"><Label>(ii)</Label><Text>an annual special assessment charge for water and sewerage, based on the frontage and the area of the lot, at the rate set out in Schedule IV.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-06-17" lims:fid="495547" lims:id="495547"><Label>(3)</Label><Text>For the purposes of subsections (1) and (2), in determining the frontage of a lot,</Text><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495548" lims:id="495548"><Label>(a)</Label><Text>the frontage of a lot fronting or abutting on only one street is the length of the side of the lot that fronts or abuts on that street;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495549" lims:id="495549"><Label>(b)</Label><Text>the frontage of a lot fronting or abutting on two or more streets along which water mains have been laid and from one of which a connection has been made is the length of the side of the lot that fronts or abuts on the street from which the connection was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495550" lims:id="495550"><Label>(c)</Label><Text>notwithstanding paragraph (b), the frontage of a corner lot at an intersection of water mains is the length of the longest side of the lot plus 25 feet, except that where the shortest side of the lot is less than 25 feet in length, the frontage is the aggregate of the longest and shortest sides;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495551" lims:id="495551"><Label>(d)</Label><Text>notwithstanding paragraph (c), the frontage of a lot fronting or abutting on two or more streets along which water mains have been laid and from more than one of which connections have been made is twice the length of the longest side of the lot;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495552" lims:id="495552"><Label>(e)</Label><Text>for the purposes of paragraphs (a) to (d), the frontage of a lot the sides of which are not parallel is that number of feet that bears the same ratio to the frontage in feet of the nearest rectangular lot in the same block as the square root of the area of the irregular lot is to the square root of the area of the rectangular lot; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="495553" lims:id="495553"><Label>(f)</Label><Text>notwithstanding paragraphs (a) to (e), where a lot has no buildings, or where each building on the lot has a floor area of less than 300 square feet, and the lot forms part of a group of lots, having a combined frontage, calculated under those paragraphs, of more than 200 feet, each of which is being used in connection with a single enterprise, the frontage of the lot is one-half the amount determined under any of paragraphs (a) to (e).</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-06-17" the units on the lot,</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2006-03-22" lims:fid="495577" lims:id="495577"><FormulaTerm>F</FormulaTerm><Text>is the total capital costs of the sewer system, and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2006-03-22" lims:fid="495578" lims:id="495578"><FormulaTerm>G</FormulaTerm><Text>is the aggregate of the base factors for all units in the park that are connected to the sewer system.</Text></FormulaDefinition></FormulaGroup></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495579" lims:id="495579"><Label>(2)</Label><Text>The aggregate of the lot volume values for all lots in each of the parks referred to in subsection (1) and the total cost incurred to provide water and sewer services to each park shall be calculated on March 31, 1996 and on that date in every subsequent year.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" to the park water system, pay an annual water charge that is calculated by multiplying the volume of water consumed that year indicated by the lot’s water meter by the rate determined under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495588" lims:id="495588"><Label>(2)</Label><Text>The superintendent of each of the parks referred to in subsection (1) shall, on or before March 31 of each year, determine the rate, corresponding to the estimated cost per cubic metre of water, of providing water service in the park in the following year, in servicing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495605" lims:id="495605"><Label>(k)</Label><Text>power supply;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495606" lims:id="495606"><Label>(l)</Label><Text>inspection and installation of water meters;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495607" lims:id="495607"><Label>(m)</Label><Text>water utility fee invoicing and invoice collection and recording; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495608" lims:id="495608"><Label>(n)</Label><Text>anything else related to the establishment, operation, maintenance and administration of the water service system.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495609" lims:id="495609"><Label>(4)</Label><Text>The superintendent of each of the parks referred to in subsection (1) shall, on or before June 30 of each year, calculate the actual total cost of providing water service in the park for the immediately preceding year in accordance with the description of B of the formula in subsection (2) by substituting actual costs for estimated costs.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495610" lims:id="495610"><Label>(5)</Label><Text>If the actual total cost of providing water service in the park for the immediately preceding year calculated in accordance with subsection (4) differs from the estimated total cost of providing water service in the park for that year, the estimated total cost of providing water service in the park for the current year shall be adjusted as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495611" lims:id="495611"><Label>(a)</Label><Text>if the actual total cost is greater than the estimated total cost, the difference shall be added to the estimated total cost of providing water service in the park for the current year; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495612" lims:id="495612"><Label>(b)</Label><Text>if the actual total cost is less than the estimated total cost, the difference shall be deducted from the estimated total cost of providing water service in the park for the current year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495613" lims:id="495613"><Label>(6)</Label><Text>The following charges are payable separately by an owner of a lot in any of the parks referred to in subsection (1) for services requested by the owner:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495614" lims:id="495614"><Label>(a)</Label><Text>each time the water supply in respect of the lot is turned on or off, a service charge of $25;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495615" lims:id="495615"><Label>(b)</Label><Text>when the water meter serving a lot is tested by a qualified person hired by the superintendent, a service charge equivalent to the amount charged by that person to the superintendent; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495616" lims:id="495616"><Label>(c)</Label><Text>when water from any source in the park is purchased by an owner of a lot and delivered to the lot by truck or through hydrants, a service charge calculated by multiplying the number of cubic metres of water purchased by the rate applicable for that year as determined under subsection (2).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495617" lims:id="495617"><Label>(7)</Label><Text>Any person who, for construction purposes, purchases water from any source in any of the parks referred to in subsection (1) shall pay a service charge calculated by multiplying the number of cubic metres of water purchased by the rate applicable for that year as determined under subsection lims:inforce-start-date="2006-03-22" lims:fid="495621" lims:id="495621"><Label>(1)</Label><Text>Every owner of a lot located in Banff National Park of Canada, Jasper National Park of Canada or Yoho National Park of Canada shall, where the lot is connected to the park sewer system, pay an annual sewerage charge that is calculated by multiplying the volume of water consumed that year indicated by the lot’s water meter by the rate determined under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495622" lims:id="495622"><Label>(2)</Label><Text>The superintendent of each of the parks referred to in subsection (1) shall, on or before March 31 of each year, determine the rate, corresponding to the estimated cost per cubic metre of water, of providing sewerage services in the park in the following year, in accordance with the formula</Text><FormulaGroup lims:inforce-start-date="2006-03-22" lims:fid="495623" lims:id="495623"><Formula maintenance;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495631" lims:id="495631"><Label>(c)</Label><Text>sewage treatment;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495632" lims:id="495632"><Label>(d)</Label><Text>reservoir maintenance;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495633" lims:id="495633"><Label>(e)</Label><Text>pumping;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495634" lims:id="495634"><Label>(f)</Label><Text>sewage meter maintenance and reading;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495635" lims:id="495635"><Label>(g)</Label><Text>maintenance relating to thawing, leak detection and main breaks;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495636" lims:id="495636"><Label>(h)</Label><Text>debt servicing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495637" lims:id="495637"><Label>(i)</Label><Text>capital infrastructure;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495638" lims:id="495638"><Label>(j)</Label><Text>power supply;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495639" lims:id="495639"><Label>(k)</Label><Text>sewerage utility fee invoicing and invoice collection and recording; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495640" lims:id="495640"><Label>(l)</Label><Text>anything else related to the establishment, operation, maintenance and administration of the sewer system.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495641" lims:id="495641"><Label>(4)</Label><Text>The superintendent of each of the parks referred to in subsection (1) shall, on or before June 30 of each year, calculate the actual total cost of providing sewerage services in the park for the immediately preceding year in accordance with the description of E of the formula in subsection (2) by substituting actual costs for estimated costs.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495642" lims:id="495642"><Label>(5)</Label><Text>If the actual total cost of providing sewerage services in the park for the immediately preceding year calculated in accordance with subsection (4) differs from the estimated total cost of providing sewerage services in the park for that year, the estimated total cost of providing sewerage services in the park for the current year shall be adjusted as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495643" lims:id="495643"><Label>(a)</Label><Text>if the actual total cost is greater than the estimated total cost, the difference shall be added to the estimated total cost of providing sewerage services in the park for the current year; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495644" lims:id="495644"><Label>(b)</Label><Text>if the actual total cost is less than the estimated total cost, the difference shall be deducted from the estimated total cost of providing sewerage services in the park for the current year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495645" lims:id="495645"><Label>(6)</Label><Text>Every owner of a lot located in any of the parks referred to in subsection (1) shall, if the lot is not connected to the park water system and the lot is served with water from another source, install a water meter, approved by the superintendent under subsection (7), to measure the quantity of water consumed from that other source for the purpose of calculating the annual sewerage charge in accordance with subsections (1) to (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495646" lims:id="495646"><Label>(7)</Label><Text>The superintendent shall approve any water meter that an owner proposes to install if the water meter is operational and compatible with the water metering system in the park.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="495647" lims:id="495647"><Label>(8)</Label><Text>Every owner of a lot located in any of the parks referred to in subsection (1) shall, if the owner uses a septic tank or holding tank sewage system and the sewage must be removed from the lot by mechanical means and delivered to a sewage treatment plant by truck, pay a sewage treatment fee of $40 per truckload.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="495649" lims:id="495649">SOR/2001-320, s. purposes of subsection 16(1), the superintendent of each park referred to in that subsection shall, on March 31 of each year, make available to each owner of a lot in that park</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495651" lims:id="495651"><Label>(a)</Label><Text>the volume value of each unit on the lot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495652" lims:id="495652"><Label>(b)</Label><Text>the lot volume value for the lot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495653" lims:id="495653"><Label>(c)</Label><Text>the base factor for all units on the lot;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495654" lims:id="495654"><Label>(d)</Label><Text>the total operating and maintenance costs and total capital costs incurred to provide water services in the park;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495655" lims:id="495655"><Label>(e)</Label><Text>the total operating and maintenance costs and total capital costs incurred to provide sewer services in the park;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495656" lims:id="495656"><Label>(f)</Label><Text>the aggregate of the lot volume values for all lots in the park that are connected to the water system;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495657" lims:id="495657"><Label>(g)</Label><Text>the aggregate of the lot volume values for all lots in the park that are connected to the sewer system;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495658" lims:id="495658"><Label>(h)</Label><Text>the aggregate of the base factors for all units in the park that are connected to the water system; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="495659" lims:id="495679"><Label>(ii)</Label><Text>for six months or more but less than 12 months in any period referred to in subparagraph (i), the quantity charge payable by the owner for such period is half lims:id="495680"><Label>(2)</Label><Text>A service charge of $0.50 is payable by an owner of any lot each time the water supply in respect of the lot is turned on or turned off pursuant to section 13
