pension plan, as defined under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal>, for the purpose of obtaining the approval of that province for</Text><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="221550" lims:id="221550"><Label>(a)</Label><Text>the creation, for the purposes of this Act, of an information bank to be controlled by the Department of Employment and Social Development in respect of contributors to and beneficiaries under that comprehensive pension plan; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-12" lims:fid="221551" lims:id="221551"><Label>(b)</Label><Text>the release of information under this Part from the information bank referred to in paragraph (a) and from any other information bank controlled by the Department of Employment and Social Development that contains information in respect of contributors to and beneficiaries under that comprehensive pension under section 7 in relation to the establishment or variation of a support provision must be accompanied by</Text><Paragraph lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428469" lims:id="1428469"><Label>(a)</Label><Text>an affidavit that sets out the reasons for the making of the application; and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428470" lims:id="1428470"><Label>(b)</Label><Text>in the case of an application in relation to the variation of a support provision, a copy of the order that contains the support provision.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428471" lims:id="1428471"><MarginalNote lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428472" lims:id="1428472"><Language xml:lang="la">Ex parte</Language> application</MarginalNote><Label>(2)</Label><Text>If the application is made <Language xml:lang="la">ex parte</Language>, the affidavit referred to in paragraph (1)(a) must also</Text><Paragraph respect of whom the applicant is seeking to have a support provision established or varied and that the person has not been located; and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428476" lims:id="1428476"><Language xml:lang="la">Ex parte</Language> application by individual</MarginalNote><Label>(3)</Label><Text>If the application is made <Language xml:lang="la">ex parte</Language> by an individual,</Text><Paragraph lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428477" lims:id="1428477"><Label>(a)</Label><Text>the application must also be accompanied by the results of a recent criminal record check in respect of the applicant and copies of the documents referred to in subparagraph (b)(ii), if any; and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428478" lims:id="1428478"><Label>(b)</Label><Text>the affidavit referred to in paragraph (1)(a) must also</Text><Subparagraph lims:inforce-start-date="2023-11-15" lims:enacted-date="2019-06-21" lims:fid="1428479" lims:id="1428479"><Label>(i)</Label><Text>state that the sole purpose of the application is to obtain information for the establishment or variation whether or not there is a court order, agreement, undertaking or recognizance or any other document that is of a similar nature that restricts the applicant’s communication or contact with the person lims:enacted-date="2019-06-21" lims:fid="1159433" lims:id="1328052">An application must contain a statement by an officer of the provincial enforcement service confirming the that the provincial enforcement service has reasonable grounds to believe that the debtor is in persistent arrears,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="221867" lims:id="221867"><Label>(ii)</Label><Text>stating that the provincial enforcement service intends to make a licence denial application in relation to the debtor,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="221868" lims:id="221868"><Label>(iii)</Label><Text>informing the debtor of the consequences to the debtor of a licence denial application, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="221869" lims:id="221869"><Label>(iv)</Label><Text>advising the debtor that a licence denial application will not be made if the debtor enters into a payment plan that is acceptable to the provincial enforcement service or satisfies the provincial enforcement service that the debtor is unable to pay the amount in arrears and that the making of the application is not reasonable in the circumstances.</Text></Subparagraph></Paragraph></Subsection><Subsection
