lims:inforce-start-date="2007-04-15" lims:fid="402902" lims:id="402902" format-ref="indent-0-0" list-item="no" language-align="no"><Text>the federal public administration is an important national institution and is part of the essential framework of Canadian parliamentary democracy;</Text></Provision><Provision lims:inforce-start-date="2007-04-15" lims:fid="402903" lims:id="402903" format-ref="indent-0-0" list-item="no" language-align="no"><Text>it is in the public interest to maintain and enhance public confidence in the integrity of public servants;</Text></Provision><Provision lims:inforce-start-date="2007-04-15" lims:fid="402904" lims:id="402904" format-ref="indent-0-0" list-item="no" language-align="no"><Text>confidence in public institutions can be enhanced by establishing effective procedures for the disclosure of wrongdoings and for protecting public servants who disclose wrongdoings, and by establishing a code of conduct for the public sector;</Text></Provision><Provision lims:inforce-start-date="2007-04-15" lims:fid="402905" lims:id="402905" format-ref="indent-0-0" list-item="no" language-align="no"><Text>public servants owe a duty of loyalty to their employer and enjoy the right to freedom of expression as guaranteed by the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal> and that this Act strives to achieve an appropriate balance between those two important principles;</Text></Provision><Provision lims:inforce-start-date="2007-04-15" lims:fid="402906" lims:id="402906" format-ref="indent-0-0" list-item="no" language-align="no"><Text>the Government of Canada commits to establishing a Charter of Values of Public Service setting out the values that should guide public servants in their work and professional conduct;</Text></Provision><HistoricalNote>2005, c. 46, s. 59(E).</HistoricalNote></Preamble><Enacts list-item="no"><Text>Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2007-04-15" lims:fid="402910" lims:id="402910"><Heading lims:inforce-start-date="2007-04-15" lims:fid="402911" lims:id="402911" level="1"><TitleText>Short lims:fid="402913" lims:id="402913">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="P-31.9">Public Servants Disclosure Protection Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2007-04-15" lims:fid="402914" lims:id="402914" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="402915" lims:id="402915"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402916" lims:id="402916">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="402917" lims:id="402917"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2012-03-16" lims:fid="402918" lims:id="402918"><Text><DefinedTermEn>Agency</DefinedTermEn><Repealed>[Repealed, 2010, c. 12, s. 1678]</Repealed></Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402919" lims:id="402919"><Text><DefinedTermEn>chief executive</DefinedTermEn> means the deputy head or chief executive officer of any portion of the public sector, or the person who occupies any other similar position, however called, in the public sector. (<DefinedTermFr>administrateur général</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402920" lims:id="402920"><Text><DefinedTermEn>Commissioner</DefinedTermEn> means the Public Sector Integrity Commissioner appointed under subsection 39(1). (<DefinedTermFr>commissaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402921" lims:id="402921"><Text><DefinedTermEn>investigation</DefinedTermEn> means, for the purposes of sections 24, 25, 26 to 31, 33, 34, 36 and 37, an investigation into a disclosure and an investigation commenced under section 33. (<DefinedTermFr>enquête</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402922" lims:id="402922"><Text><DefinedTermEn>member of the Royal Canadian Mounted Police</DefinedTermEn> means a person who is a member or a special constable of the Royal Canadian Mounted Police or who is employed by that force under terms and conditions substantially the same as those of one of its members. (<DefinedTermFr>membre de la Gendarmerie royale du Canada</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402923" lims:id="402923"><Text><DefinedTermEn>Minister</DefinedTermEn><Repealed>[Repealed, 2010, c. 12, s. 1678]</Repealed></Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402924" lims:id="402924"><Text><DefinedTermEn>protected disclosure</DefinedTermEn> means a disclosure that is made in good faith and that is made by a public servant</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402925" lims:id="402925"><Label>(a)</Label><Text>in accordance with this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402926" lims:id="402926"><Label>(b)</Label><Text>in the course of a parliamentary proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402927" lims:id="402927"><Label>(c)</Label><Text>in the course of a procedure established under any other Act of Parliament; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402928" lims:id="402928"><Label>(d)</Label><Text>when lawfully required to do so. (<DefinedTermFr>divulgation protégée</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402929" lims:id="402929"><Text><DefinedTermEn>public sector</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402930" lims:id="402930"><Label>(a)</Label><Text>the departments named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> and the other portions of the federal public administration named in Schedules I.1 to V to that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402931" lims:id="402931"><Label>(b)</Label><Text>the Crown corporations and the other public bodies set out in Schedule 1.</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2012-03-16" lims:fid="402932" lims:id="402932"><Text>However, subject to sections <XRefInternal>52</XRefInternal> and <XRefInternal>53</XRefInternal>, <DefinedTermEn>public sector</DefinedTermEn> does not include the Canadian Forces, the Canadian Security Intelligence Service or the Communications Security Establishment. (<DefinedTermFr>secteur public</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402933" lims:id="402933"><Text><DefinedTermEn>public servant</DefinedTermEn> means every person employed in the public sector, every member of the Royal Canadian Mounted Police and every chief executive. (<DefinedTermFr>fonctionnaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402934" lims:id="402934"><Text><DefinedTermEn>reprisal</DefinedTermEn> means any of the following measures taken against a public servant because the public servant has made a protected disclosure or has, in good faith, cooperated in an investigation into a disclosure or an investigation commenced under section 33:</Text><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402935" lims:id="402935"><Label>(a)</Label><Text>a disciplinary measure;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402936" lims:id="402936"><Label>(b)</Label><Text>the demotion of the public servant;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402937" lims:id="402937"><Label>(c)</Label><Text>the termination of employment of the public servant, including, in the case of a member of the Royal Canadian Mounted Police, a discharge or dismissal;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402938" lims:id="402938"><Label>(d)</Label><Text>any measure that adversely affects the employment or working conditions of the public servant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-16" lims:fid="402939" lims:id="402939"><Label>(e)</Label><Text>a threat to take any of the measures referred to in any of paragraphs (a) to (d). (<DefinedTermFr>représailles</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402940" lims:id="402940"><Text><DefinedTermEn>senior officer</DefinedTermEn> means a senior officer designated under subsection <XRefInternal>10</XRefInternal>(2). (<DefinedTermFr>agent supérieur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402941" lims:id="402941"><Text><DefinedTermEn>Tribunal</DefinedTermEn> means the Public Servants Disclosure Protection Tribunal established under subsection 20.7(1). (<DefinedTermFr>Tribunal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="402942" lims:id="402942"><Text><DefinedTermEn>wrongdoing</DefinedTermEn> means a wrongdoing referred to in section <XRefInternal>8</XRefInternal>. (<DefinedTermFr>acte répréhensible</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="402943" lims:id="402943"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402944" lims:id="402944">Taking a reprisal</MarginalNote><Label>(2)</Label><Text>Every reference in this Act to a person who has taken a reprisal includes a person who has directed the lims:id="402948" level="1"><TitleText>Amending the Schedules</TitleText></Heading><Section lims:inforce-start-date="2007-04-15" lims:lastAmendedDate="2007-04-15" lims:fid="402949" lims:id="402949"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="402950" lims:id="402950">Amending the schedules</MarginalNote><Label>3</Label><Text>The Governor in Council may, by order, amend</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402951" lims:id="402951"><Label>(a)</Label><Text>Schedule 1 by adding the name of any Crown corporation or other public body;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402952" lims:id="402952"><Label>(b)</Label><Text>Schedule 2 by adding or deleting the name of any portion of the public sector that has a statutory mandate to investigate other portions of the public sector; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402953" lims:id="402953"><Label>(c)</Label><Text>Schedule 3 by adding or deleting any provision of any Act of Parliament.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-04-15" lims:fid="402956" lims:id="402956" level="1"><TitleText>Promoting Ethical Practices</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="402957" lims:id="402957"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402958" lims:id="402958">Promotion of ethical practices and dissemination of information</MarginalNote><Label>4</Label><Text>The President of the Treasury Board must promote ethical practices in the public sector and a positive environment for disclosing wrongdoings by disseminating knowledge of this Act and information about its purposes and processes and by any other means that he or she considers 1682</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2007-04-15" lims:fid="402961" lims:id="402961" level="1"><TitleText>Code of Conduct</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="402962" lims:id="402962"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402963" lims:id="402963">Obligation to establish — Treasury Board</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="402964" lims:id="402964"><Label>(1)</Label><Text>The Treasury Board must establish a code of conduct applicable to the public sector.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="402965" lims:id="402965"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402966" lims:id="402966">Other provisions do not apply</MarginalNote><Label>(2)</Label><Text>The Treasury Board’s obligation under subsection (1) applies despite the provisions of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> and of any other Act of Parliament that otherwise restrict the powers of the Treasury Board.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="402967" lims:id="402967"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402968" lims:id="402968">Consultation with organizations</MarginalNote><Label>(3)</Label><Text>Before the code of conduct is established, the President of the Treasury Board must consult with the employee organizations certified as bargaining agents in the public sector.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="402969" lims:id="402969"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402970" lims:id="402970">Code to be tabled</MarginalNote><Label>(4)</Label><Text>The President of the Treasury Board must cause the code of conduct established by the Treasury Board to be tabled before each House of Parliament at least 30 days before it comes into lims:inforce-start-date="2007-04-15" lims:fid="402974" lims:id="402974">Chief executives shall establish codes of conduct</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2007-04-15" lims:fid="402975" lims:id="402975"><Label>(1)</Label><Text>Every chief executive shall establish a code of conduct applicable to the portion of the public sector for which he or she is responsible.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="402976" lims:id="402976"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="402977" lims:id="402977">Consistency</MarginalNote><Label>(2)</Label><Text>The codes of conduct established by chief executives must be consistent with the code of conduct established by the Treasury Board.</Text></Subsection></Section><Section lims:inforce-start-date="2007-04-15" lims:lastAmendedDate="2007-04-15" lims:fid="402978" lims:id="402978"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="402979" lims:id="402979">Application</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2007-04-15" lims:fid="402980" lims:id="402980"><Label>(1)</Label><Text>The codes of conduct applicable to a portion of the public sector apply to every public servant employed in that portion of the public sector.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="402981" lims:id="402981"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="402982" lims:id="402982">Conflict — RCMP</MarginalNote><Label>(2)</Label><Text>In the event of a conflict between the code of conduct established under subsection 5(1) or 6(1) and the code of conduct established under section 38 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>, the code of conduct established under that section prevails to the extent of the conflict.</Text></Subsection></Section><Heading lims:inforce-start-date="2007-04-15" lims:fid="402983" lims:id="402983" level="1"><TitleText>Wrongdoings</TitleText></Heading><Section lims:inforce-start-date="2007-04-15" lims:lastAmendedDate="2007-04-15" lims:fid="402984" lims:id="402984"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="402985" lims:id="402985">Wrongdoings</MarginalNote><Label>8</Label><Text>This Act applies in respect of the following wrongdoings in or relating to the public sector:</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402986" lims:id="402986"><Label>(a)</Label><Text>a contravention of any Act of Parliament or of the legislature of a province, or of any regulations made under any such Act, other than a contravention of section 19 of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402987" lims:id="402987"><Label>(b)</Label><Text>a misuse of public funds or a public asset;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402988" lims:id="402988"><Label>(c)</Label><Text>a gross mismanagement in the public sector;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402989" lims:id="402989"><Label>(d)</Label><Text>an act or omission that creates a substantial and specific danger to the life, health or safety of persons, or to the environment, other than a danger that is inherent in the performance of the duties or functions of a public servant;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402990" lims:id="402990"><Label>(e)</Label><Text>a serious breach of a code of conduct established under section <XRefInternal>5</XRefInternal> or <XRefInternal>6</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402991" lims:id="402991"><Label>(f)</Label><Text>knowingly directing or counselling a person to commit a wrongdoing set out in any of paragraphs (a) to (e).</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="402992" lims:id="402992"><Label>(g)</Label><Text><Repealed>[Repealed, 2006, c. 9, s. 197]</Repealed></Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-04-15" lims:fid="402994" lims:id="402994">2005, c. 46, s. 8; 2006, c. 9, s. 197</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2007-04-15" lims:lastAmendedDate="2007-04-15" lims:fid="402995" lims:id="402995"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="402996" lims:id="402996">Disciplinary action</MarginalNote><Label>9</Label><Text>In addition to, and apart from, any penalty provided for by law, a public servant is subject to appropriate disciplinary action, including termination of employment, if he or she commits a wrongdoing.</Text></Section><Heading lims:inforce-start-date="2007-04-15" lims:fid="402997" lims:id="402997" level="1"><TitleText>Disclosure of Wrongdoings</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="402998" lims:id="402998"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="402999" lims:id="402999">Establishment of internal disclosure procedures</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2012-03-16" lims:fid="403000" lims:id="403000"><Label>(1)</Label><Text>Each chief executive must establish internal procedures to manage disclosures made under this Act by public servants employed in the portion of the public sector for which the chief executive is responsible.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="403001" lims:id="403001"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="403002" lims:id="403002">Designation of senior officer</MarginalNote><Label>(2)</Label><Text>Each chief executive must designate a senior officer to be responsible for receiving and dealing with, in accordance with the duties and powers of senior officers set out in the code of conduct established by the Treasury Board, disclosures of wrongdoings made by public servants employed in the portion of the public sector for which the chief executive is responsible.</Text></Subsection><Subsection lims:inforce-start-date="2012-03-16" lims:fid="403003" lims:id="403003"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="403004" lims:id="403004">Senior officer from other portion of public sector</MarginalNote><Label>(3)</Label><Text>A chief executive may designate as a senior officer for the portion of the public sector for which the chief executive is responsible a person who lims:inforce-start-date="2007-04-15" lims:fid="403138" lims:id="403138"><Label>(a)</Label><Text>the implementation of the disciplinary action — and the commencement or continuation of any procedure in relation to the disciplinary action by the person under any other Act of Parliament or collective agreement — is suspended for the period referred to in subsection (3); dealing with it on the merits, other than a decision made under the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>,</Text><Paragraph Commissioner may apply to the Tribunal for a determination of whether or not a reprisal was taken against the complainant and, if the Tribunal determines that a reprisal was taken, for</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403216" lims:id="403216"><Label>(a)</Label><Text>an order respecting a remedy in favour of the complainant; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403217" lims:id="403217"><Label>(b)</Label><Text>an order respecting a remedy in favour of the complainant and an order respecting disciplinary action against any person or persons identified by the Commissioner in the application as being the person or persons who took the lims:id="403219">Exception</MarginalNote><Label>(2)</Label><Text>The order respecting disciplinary action referred in paragraph (1)(b) may not be applied for in relation to a complaint the filing of lims:fid="403221" lims:id="403221">Factors</MarginalNote><Label>(3)</Label><Text>In considering whether making an application to the Tribunal is warranted, the Commissioner must take into account whether</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403222" lims:id="403222"><Label>(a)</Label><Text>there are reasonable grounds for believing that a reprisal was taken against the complainant;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403223" lims:id="403223"><Label>(b)</Label><Text>the investigation into the complaint could not be completed because of lack of cooperation on the part of one or more chief executives or public servants;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403224" lims:id="403224"><Label>(c)</Label><Text>the complaint should be dismissed on any ground mentioned in paragraphs 19.3(1)(a) to (d); and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403225" lims:id="403225"><Label>(d)</Label><Text>having regard to all the circumstances relating to the complaint, it is in the public interest to make tribunal to be known as the Public Servants Disclosure Protection Tribunal consisting of a Chairperson and not less than two and not more than six other members to be appointed by the Governor in Council. of a first or any subsequent term of office, is eligible to be re-appointed for a further term.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403251" lims:id="403251"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403252" lims:id="403252">Temporary members</MarginalNote><Label>(4)</Label><Text>Subject to subsection (5), in addition to the members appointed under subsection (1), any judge or former judge of the Federal Court of Canada or the Federal Court or of a superior or district court of a province may, on the request of the Chairperson of the Tribunal made with the approval of the Governor in Council, act as a temporary member of the Tribunal.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" the appropriate chief executive, or any person acting on their behalf, to take all necessary measures to</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403360" lims:id="403360"><Label>(a)</Label><Text>permit the complainant to return to his or her duties;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403361" lims:id="403361"><Label>(b)</Label><Text>reinstate the complainant or pay compensation to the complainant in lieu of reinstatement if, in the Tribunal’s opinion, the relationship of trust between the parties cannot be restored;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403362" lims:id="403362"><Label>(c)</Label><Text>pay to the complainant compensation in an amount not greater than the amount that, in the Tribunal’s opinion, is equivalent to the remuneration that would, but for the reprisal, have been paid to the complainant;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403363" lims:id="403363"><Label>(d)</Label><Text>rescind any measure or action, including any disciplinary action, and pay compensation to the complainant in an amount not greater than the amount that, in the Tribunal’s opinion, is equivalent to any financial or other penalty imposed on the complainant;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403364" lims:id="403364"><Label>(e)</Label><Text>pay to the complainant an amount equal to any expenses and any other financial losses incurred by the complainant as a direct result of the reprisal; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403365" lims:id="403365"><Label>(f)</Label><Text>compensate the complainant, by an amount of not more than $10,000, for any pain and suffering that the complainant experienced as a result of the reprisal.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403366" lims:id="403366"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="403367" lims:id="403367"><XRefExternal reference-type="act" necessary measures to take the disciplinary action, including termination of employment or revocation of appointment, specified by the Tribunal against any person named in the application who was lims:fid="403374" lims:id="403374">Factors</MarginalNote><Label>(2)</Label><Text>In making the order the Tribunal must take into account the factors ordinarily considered by employers when they discipline their employees, including, but not limited to,</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403375" lims:id="403375"><Label>(a)</Label><Text>the gravity of the reprisal;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403376" lims:id="403376"><Label>(b)</Label><Text>the level of responsibility inherent in the position that the person occupies;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403377" lims:id="403377"><Label>(c)</Label><Text>the person’s previous employment record;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403378" lims:id="403378"><Label>(d)</Label><Text>whether the reprisal was an isolated incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403379" lims:id="403379"><Label>(e)</Label><Text>the person’s rehabilitative potential; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403380" lims:id="403380"><Label>(f)</Label><Text>the deterrent effect of the disciplinary action.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403381" lims:id="403381"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="403382" lims:id="403382">Additional factors</MarginalNote><Label>(3)</Label><Text>In making the order the Tribunal must also take into account</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403383" lims:id="403383"><Label>(a)</Label><Text>the extent to which the nature of the reprisal discourages the disclosure of wrongdoing under this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403384" lims:id="403384"><Label>(b)</Label><Text>the extent to which inadequate disciplinary action in relation to the reprisal would have an adverse effect on confidence in public institutions.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403385" lims:id="403385"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="403386" lims:id="403386">Grievance precluded</MarginalNote><Label>(4)</Label><Text>The person against whom disciplinary action is taken as a result of an order made under subsection (1) may not initiate a grievance or other similar procedure under an Act of Parliament or a collective agreement in respect of the disciplinary action.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403387" lims:id="403387"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="403388" lims:fid="403406" lims:id="403406">Duties</MarginalNote><Label>22</Label><Text>The duties of the Commissioner under this Act are to</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403407" lims:id="403407"><Label>(a)</Label><Text>provide information and advice regarding the making of disclosures under this Act and the conduct of investigations by the Commissioner;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403408" lims:id="403408"><Label>(b)</Label><Text>receive, record and review disclosures of wrongdoings in order to establish whether there are sufficient grounds for further action;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403409" lims:id="403409"><Label>(c)</Label><Text>conduct investigations of disclosures made in accordance with section <XRefInternal>13</XRefInternal>, and investigations referred to in section <XRefInternal>33</XRefInternal>, including to appoint persons to conduct the investigations on his or her behalf;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403410" lims:id="403410"><Label>(d)</Label><Text>ensure that the right to procedural fairness and natural justice of all persons involved in investigations is respected, including persons making disclosures, witnesses and persons alleged to be responsible for wrongdoings;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403411" lims:id="403411"><Label>(e)</Label><Text>subject to any other Act of Parliament, protect, to the extent possible in accordance with the law, the identity of persons involved in the disclosure process, including that of persons making disclosures, witnesses and persons alleged to be responsible for wrongdoings;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403412" lims:id="403412"><Label>(f)</Label><Text>establish procedures for processing disclosures and ensure the confidentiality of information collected in relation to disclosures and investigations;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403413" lims:id="403413"><Label>(g)</Label><Text>review the results of investigations into disclosures and those commenced under section 33 and report his or her findings to the persons who made the disclosures and to the appropriate chief executives;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403414" lims:id="403414"><Label>(h)</Label><Text>make recommendations to chief executives concerning the measures to be taken to correct wrongdoings and review reports on measures taken by chief executives in response to those recommendations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403415" lims:id="403415"><Label>(i)</Label><Text>receive, review, investigate and otherwise deal with complaints made in respect of reprisals.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-04-15" lims:fid="403417" lims:id="403417">2005, c. (1),</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403423" lims:id="403423"><Label>(a)</Label><Text>the Commissioner of the Royal Canadian Mounted Police, or his or her delegate, is not acting as a law enforcement authority when taking any action under section 20.2 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403424" lims:id="403424"><Label>(b)</Label><Text>a person or body dealing with a matter in the course of an investigation or proceeding under Part IV of that Act is not dealing with the matter as a law enforcement authority.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem refuse</MarginalNote><Label>24</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403429" lims:id="403429"><Label>(1)</Label><Text>The Commissioner may refuse to deal with a disclosure or to commence an investigation — and he or she may cease an investigation — if he or she is of the opinion that</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403430" lims:id="403430"><Label>(a)</Label><Text>the subject-matter of the disclosure or the investigation has been adequately dealt with, or could more appropriately be dealt with, according to a procedure provided for under another Act of Parliament;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403431" lims:id="403431"><Label>(b)</Label><Text>the subject-matter of the disclosure or the investigation is not sufficiently important;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403432" lims:id="403432"><Label>(c)</Label><Text>the disclosure was not made in good faith or the information that led to the investigation under section 33 was not provided in good faith;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403433" lims:id="403433"><Label>(d)</Label><Text>the length of time that has elapsed since the date when the subject-matter of the disclosure or the investigation arose is such that dealing with it would serve no useful purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403434" lims:id="403434"><Label>(e)</Label><Text>the subject-matter of the disclosure or the investigation relates to a matter that results from a balanced and informed decision-making process on a public policy issue; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="403435" lims:id="403435"><Label>(f)</Label><Text>there is a valid reason for not dealing with the subject-matter of the disclosure or the investigation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403436" lims:id="403436"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="403437" lims:id="403437">Adjudicative decisions</MarginalNote><Label>(2)</Label><Text>The Commissioner must refuse to deal with a disclosure or to commence an investigation if he or she is of the opinion that the subject matter of the disclosure or the investigation relates solely to a decision that was made in the exercise of an adjudicative function under an Act of Parliament, including a decision of the Commissioner of the Royal Canadian Mounted Police under Part IV of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="403438" lims:id="403438"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="403439" lims:id="403439">Jurisdiction of the Conflict of Interest and Ethics Commissioner</MarginalNote><Label>(2.1)</Label><Text>The Commissioner must refuse to deal with a disclosure or to commence an investigation if he or she is of the opinion that the subject-matter of the disclosure or the investigation is within the jurisdiction of the Conflict of Interest and Ethics Commissioner under the <XRefExternal reference-type="act" link="C-36.65">Conflict of Interest Act</XRefExternal> and must refer the matter to the Conflict of Interest and Ethics lims:fid="403450" lims:id="403450"><Label>(d)</Label><Text>the power in section 20.4 to apply to the Tribunal;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403451" lims:id="403451"><Label>(e)</Label><Text>the power in section 20.5 to dismiss a complaint;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403452" lims:id="403452"><Label>(f)</Label><Text>the duties in paragraphs 22(g) and (h) to review the result of investigations, to report findings and to make recommendations;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403453" lims:id="403453"><Label>(g)</Label><Text>the power in section 24 to refuse to deal with a disclosure or to commence an investigation, the power in that section to cease an investigation and the duty in that section to provide reasons;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403454" lims:id="403454"><Label>(h)</Label><Text>the power to issue, in the exercise of any powers referred to in subsection 29(1), a subpoena or other request or summons to appear before the Commissioner or a person appointed to conduct an investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403455" lims:id="403455"><Label>(i)</Label><Text>the power in section 33 to commence an investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403456" lims:id="403456"><Label>(j)</Label><Text>the power in section 34 to refer a matter to another authority;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403457" lims:id="403457"><Label>(k)</Label><Text>the power in subsection 35(1) to remit information;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403458" lims:id="403458"><Label>(l)</Label><Text>the power to request that a chief executive provide notice as referred to in section 36; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403459" lims:id="403459"><Label>(m)</Label><Text>the power in section 37 and the power and duties in section 38 to make a report.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403460" lims:id="403460"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403461" lims:id="403461">Restriction concerning certain investigations</MarginalNote><Label>(2)</Label><Text>The Commissioner may not delegate the conduct of an investigation that involves or may involve information relating to international relations, national defence, national security or the detection, prevention or suppression of criminal, subversive or hostile activities, except to one of a maximum of four officers or employees of the Office of the Public Sector Integrity Commissioner specifically designated by the Commissioner for the may constitute a wrongdoing under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403469" lims:id="403469"><Label>(c)</Label><Text>any public servant who has made a disclosure under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403470" lims:id="403470"><Label>(d)</Label><Text>any person who is or has been involved in any investigation conducted by a senior officer or by or on behalf of the Commissioner under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403471" lims:id="403471"><Label>(e)</Label><Text>any public servant who is considering making a complaint under this Act regarding an alleged reprisal taken against him or her; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403472" lims:id="403472"><Label>(f)</Label><Text>any person who is or has been involved in a proceeding under this Act regarding an alleged reprisal.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403473" lims:id="403473"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403474" lims:id="403474">Condition</MarginalNote><Label>(2)</Label><Text>The Commissioner may provide the access to legal advice only if the public servant or person satisfies the Commissioner that they do not have other access to legal advice at no cost to them.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403475" lims:id="403475"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403476" lims:id="403476">Additional condition</MarginalNote><Label>(3)</Label><Text>In addition to the condition referred to in subsection (2), the Commissioner may provide access to legal advice to a public servant referred to in paragraph (1)(a) or a person referred to in paragraph (1)(b) only if the Commissioner is of the opinion that the act or omission to which the disclosure or the information relates, as the case may be, likely constitutes a wrongdoing under this Act and that the disclosure or the provision of the information is likely lims:inforce-start-date="2007-04-15" lims:fid="403478" lims:id="403478">Maximum payment</MarginalNote><Label>(4)</Label><Text>The maximum amount that may be paid by the Commissioner under this section for legal advice provided or to be provided to any particular public servant or person in relation to any particular act or omission that may constitute a wrongdoing or reprisal is $1,500.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403479" lims:id="403479"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403480" lims:id="403480">Maximum value</MarginalNote><Label>(5)</Label><Text>If, for the purpose of this section, the Commissioner chooses to provide access to legal advice to any particular public servant or person in relation to a particular act or omission that may constitute a wrongdoing or reprisal through legal counsel employed in his or her office, the monetary value of the time spent by them in The provisions of this Act applicable to investigations commenced as the result of a disclosure apply to investigations commenced under this section.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403538" lims:id="403538"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403539" lims:id="403539">Restriction</MarginalNote><Label>(2)</Label><Text>The Commissioner may not, in the course of an investigation commenced under subsection (1), use a confidence of the Queen’s Privy Council for Canada in respect of which subsection 39(1) of the <XRefExternal reference-type="act" link="C-5">Canada Evidence Act</XRefExternal> applies, or information that is subject to solicitor-client privilege, if the confidence or information is disclosed to the Commissioner.</Text></Subsection></Section><Section lims:inforce-start-date="2007-04-15" sector</MarginalNote><Label>34</Label><Text>If the Commissioner is of the opinion that a matter under investigation would involve obtaining information that is outside the public sector, he or she must cease that part of the investigation and he or she may refer the matter to any authority that he or she considers competent to deal with it.</Text></Section><Section suspect that information obtained in the course of an investigation may be used in the investigation or prosecution of an alleged contravention of any Act of Parliament or of the legislature of a province, he or she may, in addition to or in lieu of continuing the investigation, remit the information, at that point in time, to a peace officer having jurisdiction to investigate the alleged contravention or to the Attorney General of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403545" lims:id="403545"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403546" lims:id="403546">Restriction</MarginalNote><Label>(1.1)</Label><Text>If the information relates to the Royal Canadian Mounted Police, the Commissioner may remit the information only to the Attorney General of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403547" lims:id="403547"><MarginalNote executive in respect of an investigation, the Commissioner may, if he or she considers it appropriate to do so, request that the chief executive provide the Commissioner, within a time specified in the report, with notice of any action taken or proposed to be taken to implement the recommendations contained in the report or reasons why no such action has been or is proposed to be the Commissioner has made and their status;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403569" lims:id="403569"><Label>(d.1)</Label><Text>in relation to complaints made in relation to reprisals, the number of settlements, applications to the Tribunal and decisions to dismiss them;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" report</MarginalNote><Label>(3)</Label><Text>The Commissioner may, at any time, prepare a special report referring to and commenting on any matter within the scope of his or her powers and duties under this Act if, in his or her opinion, the matter is of such urgency or importance that a report on it should not be deferred until the time provided for the submission of the annual report.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403575" lims:id="403575"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403576" lims:id="403576">Case report</MarginalNote><Label>(3.1)</Label><Text>If the Commissioner makes a report to a chief executive in respect of an investigation into a disclosure or an investigation commenced under section 33 and there is a finding of wrongdoing in the report, the Commissioner must, within 60 days after making the report, prepare a case report setting out</Text><Paragraph to whether the chief executive’s response to the report to the chief executive, up to that point in time, is satisfactory; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403581" lims:id="403581"><Label>(e)</Label><Text>the chief executive’s written comments, if any.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403582" lims:id="403582"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403583" lims:id="403583">Opportunity to make representations</MarginalNote><Label>(3.2)</Label><Text>Before making a case report, the Commissioner must provide the chief executive with a reasonable opportunity to make written lims:id="403664"><Label>(a)</Label><Text>take a disciplinary measure against the employee;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403665" lims:id="403665"><Label>(b)</Label><Text>demote the employee;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403666" lims:id="403666"><Label>(c)</Label><Text>terminate the employment of the employee;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403667" lims:id="403667"><Label>(d)</Label><Text>take any measure that adversely affects the employment or working conditions of the employee; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403668" lims:id="403668"><Label>(e)</Label><Text>threaten to take any measure referred to in paragraphs (a) to (d).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403669" lims:id="403669"><MarginalNote alleged wrongdoing in the public sector to the Commissioner or, if the alleged wrongdoing relates to the Office of the Public Sector Integrity Commissioner, to the Auditor General of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403679" lims:id="403679"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403680" lims:id="403680">Prohibition — entering into contract</MarginalNote><Label>(2)</Label><Text>A public servant or any person purporting to act on behalf of Her Majesty in right of Canada or a portion of the public sector shall not, in considering whether to enter into a contract with a person, take into account that the person or any of the person’s employees has, in the past, in good faith and on the basis of reasonable belief, provided information concerning an alleged wrongdoing in the public sector to the Commissioner or, if the alleged wrongdoing relates to the Office of the Public Sector Integrity Commissioner, to the Auditor General of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403681" lims:id="403681"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403717" lims:id="403717">Disclosure not waiver</MarginalNote><Label>48</Label><Text>The disclosure of information to the Commissioner under this Act does any restriction on disclosure created by or under any other Act of Parliament;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403725" lims:id="403725"><Label>(e)</Label><Text>could reasonably be expected to cause injury to international relations, national defence or national security, or to the detection, prevention or suppression of criminal, subversive or hostile activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403726" lims:id="403726"><Label>(f)</Label><Text>could reasonably be expected to cause injury to the privacy interests of an individual; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403727" lims:id="403727"><Label>(g)</Label><Text>could reasonably be expected to cause injury to commercial interests.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403728" lims:id="403728"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403729" lims:id="403729">Exception — previously disclosed information or consent</MarginalNote><Label>(2)</Label><Text>The Commissioner may disclose any information referred to in subsection (1) if it has already been disclosed following a request under the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal> or with the consent of the relevant individual or an authorized person in the organization that has a primary interest in the information.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" interest in making the disclosure clearly outweighs the potential harm from the disclosure.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403734" lims:id="403734"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403735" lims:id="403735">Compliance and consultation</MarginalNote><Label>(4)</Label><Text>Before disclosing any information as permitted by subsection (3), the Commissioner must</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403736" lims:id="403736"><Label>(a)</Label><Text>comply with subsection 38.02(1.1) of the <XRefExternal reference-type="act" link="C-5">Canada Evidence Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403737" duties to a public servant who is involved in a disclosure or a complaint in respect of a reprisal if the chief executive believes on reasonable grounds that the public servant’s involvement has become known in the public servant’s workplace or that the temporary assignment is necessary to maintain the effective operation of the workplace.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403751" lims:id="403751"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403752" lims:id="403752">Public servants who may be assigned other duties</MarginalNote><Label>(2)</Label><Text>For the purposes of this section, the public servants involved in a disclosure or a complaint in respect of a reprisal are</Text><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403753" lims:id="403753"><Label>(a)</Label><Text>the public servant who made the disclosure and every public servant who is the subject of the disclosure;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403754" lims:id="403754"><Label>(b)</Label><Text>the public servant who filed the complaint and every public servant who is alleged to have taken the reprisal to which the complaint relates; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-04-15" lims:fid="403755" lims:id="403755"><Label>(c)</Label><Text>every public servant who is a witness or potential witness in the investigation, if any, relating to the disclosure or in any proceeding dealing with the complaint.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403756" lims:id="403756"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403757" lims:id="403757">Duration</MarginalNote><Label>(3)</Label><Text>The assignment may be for a period of up to three months, but the chief executive may renew the assignment one or more times if he or she believes that the conditions giving rise to it continue to exist on the expiry of a previous period.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403758" lims:id="403758"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403759" lims:id="403759">Duties</MarginalNote><Label>(4)</Label><Text>Subject to subsection (7), the duties that may be assigned must be in the same portion of the public sector in which the public servant is employed and must be comparable to the public servant’s normal duties.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403760" lims:id="403760"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403761" lims:id="403761">Consent</MarginalNote><Label>(5)</Label><Text>Subsection (1) applies to a public servant, other than a public servant who is the subject of the disclosure or who is alleged to have taken the reprisal, as the case may be, only if the public servant consents in writing to the assignment. The assignment is deemed not to be a reprisal if the public servant’s consent is given.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403762" lims:id="403762"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403763" lims:id="403763">Not disciplinary action</MarginalNote><Label>(6)</Label><Text>The assignment of other duties to a public servant who is the subject of the disclosure or who is alleged to have taken the reprisal, as the case may be, is deemed not to be a disciplinary action.</Text></Subsection><Subsection lims:inforce-start-date="2007-04-15" lims:fid="403764" lims:id="403764"><MarginalNote lims:inforce-start-date="2007-04-15" lims:fid="403765" lims:id="403765">Duties in other portion of the public sector</MarginalNote><Label>(7)</Label><Text>A public servant may be temporarily assigned duties in another portion of the public sector if both the chief executive of that other portion and the public servant consent to the assignment and the duties are comparable to the public servant’s normal duties.
