list-item="no"><Text>Whereas, the annexed Regulations give effect, in part, to a public announcement made on March 22, 2013, known as Customs Notice 13-006;</Text></Provision><Provision lims:inforce-start-date="2016-06-14" lims:fid="827857" lims:id="827857" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas the Notice provides that the Regulations giving effect to that announcement come into force on April 1, 2013;</Text></Provision><Provision lims:inforce-start-date="2016-06-14" lims:fid="827858" lims:id="827858" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Public Safety and Emergency Preparedness, pursuant to Regulations.</Text><Definition lims:inforce-start-date="2016-06-14" lims:fid="827863" lims:id="827863" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="827864" lims:id="827864" generate-in-text="no"><Text><DefinedTermEn>customs administration</DefinedTermEn> means the governmental authority that is responsible under the law of Canada or of Panama, as the case may be, for the administration of its customs laws and regulations. (<DefinedTermFr>administration douanière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="827865" lims:id="827865" generate-in-text="no"><Text><DefinedTermEn>goods</DefinedTermEn> means goods for which preferential tariff treatment under the CPAFTA is claimed. (<DefinedTermFr>marchandises</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="827866" lims:id="827866" generate-in-text="no"><Text><DefinedTermEn>material</DefinedTermEn> means a good that is used in the production of another good, and includes a part or ingredient. (<DefinedTermFr>matière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="827867" lims:id="827867" generate-in-text="no"><Text><DefinedTermEn>verification letter</DefinedTermEn> means a letter that requests information regarding the origin of goods that are the subject of a verification of origin. (<DefinedTermFr>lettre de vérification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="827868" lims:id="827868" generate-in-text="no"><Text><DefinedTermEn>verification questionnaire</DefinedTermEn> means a questionnaire that requests information regarding the origin of goods that are the subject of a verification of origin. (<DefinedTermFr>questionnaire de vérification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="827869" lims:id="827869" generate-in-text="no"><Text><DefinedTermEn>verification visit</DefinedTermEn> verification visit means the entry into premises or a place for the purpose of conducting a verification of origin of goods under paragraph 42.1(1)(a) of the Act. (<DefinedTermFr>visite de vérification</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2016-06-14" lims:fid="827870" lims:id="827870" level="1"><TitleText>Manner of Conducting a Verification of Origin</TitleText></Heading><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827871" lims:id="827871"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827872" lims:id="827872">Methods in addition to verification visit</MarginalNote><Label>2</Label><Text>In addition to a verification visit, a verification of origin of goods may be conducted by reviewing the following:</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827873" lims:id="827873"><Label>(a)</Label><Text>a verification questionnaire completed by</Text><Subparagraph lims:inforce-start-date="2016-06-14" lims:fid="827874" lims:id="827874"><Label>(i)</Label><Text>the exporter or producer of the goods, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-14" lims:fid="827875" lims:id="827875"><Label>(ii)</Label><Text>a producer or supplier of a material;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827876" lims:id="827876"><Label>(b)</Label><Text>a written response received from a person referred to in paragraph (a) to a verification letter; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827877" lims:id="827877"><Label>(c)</Label><Text>any other information received from a person referred to in paragraph (a).</Text></Paragraph></Section><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827878" lims:id="827878"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827879" lims:id="827879">Verification letters and verification questionnaires</MarginalNote><Label>3</Label><Text>A verification letter or verification questionnaire must</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827880" lims:id="827880"><Label>(a)</Label><Text>identify the customs administration and specify the name and title of the officer who is sending the letter or questionnaire;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827881" lims:id="827881"><Label>(b)</Label><Text>describe the goods or materials that are the subject of the verification of origin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827882" lims:id="827882"><Label>(c)</Label><Text>specify the period within which the letter must be answered or the questionnaire must be completed and returned, and which must be a minimum of 30 days beginning on the day on which the letter or the questionnaire is received.</Text></Paragraph></Section><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827883" lims:id="827883"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827884" lims:id="827884">Extension of period</MarginalNote><Label>4</Label><Text>A person who receives a verification letter or verification questionnaire may, on a single occasion and within the period specified in the letter or questionnaire, make a written request asking for an extension of that period to the customs administration. The extension may be granted for a further period of not more than 30 days.</Text></Section><Heading lims:inforce-start-date="2016-06-14" lims:fid="827885" lims:id="827885" level="1"><TitleText>Verification Visit</TitleText></Heading><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827886" lims:id="827886"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827887" lims:id="827887">Premises</MarginalNote><Label>5</Label><Text>The premises in Panama of the following persons are prescribed premises for the purposes of a verification visit:</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827888" lims:id="827888"><Label>(a)</Label><Text>an exporter or producer of goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827889" lims:id="827889"><Label>(b)</Label><Text>a producer or supplier of a material.</Text></Paragraph></Section><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827890" lims:id="827890"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827891" lims:id="827891">Conditions</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827892" lims:id="827892"><Label>(1)</Label><Text>An officer may only conduct a verification visit if the following conditions are met:</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827893" lims:id="827893"><Label>(a)</Label><Text>an officer sends a written notice of their intention to conduct the visit to</Text><Subparagraph lims:inforce-start-date="2016-06-14" lims:fid="827894" lims:id="827894"><Label>(i)</Label><Text>the person whose premises are to be the subject of the visit,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-14" lims:fid="827895" lims:id="827895"><Label>(ii)</Label><Text>the customs administration of Panama, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-14" lims:fid="827896" lims:id="827896"><Label>(iii)</Label><Text>if requested by Panama, the Embassy of Panama that is located in Canada; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827897" lims:id="827897"><Label>(b)</Label><Text>the person whose premises are to be the subject of the visit consents in writing to it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827898" lims:id="827898"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827899" lims:id="827899">Written notice</MarginalNote><Label>(2)</Label><Text>The written notice of the verification visit must specify</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827900" lims:id="827900"><Label>(a)</Label><Text>the identity of the customs administration on whose behalf the notice is sent;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827901" lims:id="827901"><Label>(b)</Label><Text>the name and title of the officer who is to conduct the visit;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827902" lims:id="827902"><Label>(c)</Label><Text>the name of the person whose premises are to be the subject of the visit;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827903" lims:id="827903"><Label>(d)</Label><Text>the date and the place of the visit;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827904" lims:id="827904"><Label>(e)</Label><Text>the object and scope of the visit, including a description of the goods or materials that are the subject of the verification of origin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827905" lims:id="827905"><Label>(f)</Label><Text>the legal authority for the visit.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827906" lims:id="827906"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827907" lims:id="827907">Postponement</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827908" lims:id="827908"><Label>(1)</Label><Text>A person who receives a notice under subparagraph 6(1)(a)(i) may, on a single occasion and within 15 days after the day on which the notice is received request a postponement of the verification visit by sending a written request for a postponement to the officer who sent the notice.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827909" lims:id="827909"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827910" lims:id="827910">Maximum period</MarginalNote><Label>(2)</Label><Text>The postponement must not be for a period exceeding 60 days beginning on the day on which the notice is received, or for any longer period that is agreed to by the customs administration of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827911" lims:id="827911"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827912" lims:id="827912">Postponement</MarginalNote><Label>(3)</Label><Text>A verification visit is postponed if, within 15 days after the day on which the customs administration receives a notice under subparagraph 6(1)(a)(ii), the customs administration of Panama sends a written request for the postponement to the officer who sent the notice.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827913" lims:id="827913"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827914" lims:id="827914">Maximum period</MarginalNote><Label>(4)</Label><Text>The postponement must not be for a period exceeding 60 days beginning on the day on which the notice is received, or for any longer period that is agreed to by Canada and Panama.</Text></Subsection></Section><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827915" lims:id="827915"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827916" lims:id="827916">Observers</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827917" lims:id="827917"><Label>(1)</Label><Text>A person who receives a notice under subparagraph 6(1)(a)(i) may designate two observers to be present during the verification visit.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827918" lims:id="827918"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827919" lims:id="827919">Role of observers</MarginalNote><Label>(2)</Label><Text>The observers’ participation is limited to observation.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827920" lims:id="827920"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827921" lims:id="827921">Identification of observers</MarginalNote><Label>(3)</Label><Text>A person who designates observers must identify them to the officer who is conducting the verification visit.</Text></Subsection></Section><Heading lims:inforce-start-date="2016-06-14" lims:fid="827922" lims:id="827922" level="1"><TitleText>Denial or Withdrawal of Preferential Tariff Treatment under CPAFTA</TitleText></Heading><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827923" lims:id="827923"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827924" lims:id="827924">Requirements — exporter and producer</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827925" lims:id="827925"><Label>(1)</Label><Text>For the purpose of subsection 42.1(2) of the Act, the exporter and the producer of goods are, in relation to a verification of origin under paragraph 42.1(1)(a) of the Act, required to</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827926" lims:id="827926"><Label>(a)</Label><Text>maintain, in accordance with the applicable laws of the country in which the verification of origin is conducted, records relevant to the determination of origin with respect to the goods that are required to be maintained under those laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827927" lims:id="827927"><Label>(b)</Label><Text>provide the officer who is conducting the verification of origin with access to the records; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="827928" lims:id="827928"><Label>(c)</Label><Text>reply to each verification letter or complete and return each verification questionnaire to the officer within the period specified under paragraph 3(c) or section 4, as the case may be.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827929" lims:id="827929"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827930" lims:id="827930">Consent to verification visit</MarginalNote><Label>(2)</Label><Text>For the purpose of subsection 42.1(2) of the Act, consent to the verification visit must be provided in writing by the exporter or producer within 30 days after the day on which the notice sent in accordance with subparagraph 6(1)(a)(i) is received.</Text></Subsection></Section><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827931" lims:id="827931"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827932" lims:id="827932">Notice of re-determination of origin</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827933" lims:id="827933"><Label>(1)</Label><Text>An officer must send a written notice of the intent to re-determine the origin of goods under subsection 59(1) of the Act with a statement that is provided to an exporter or producer of goods under subsection 42.2(1) of the Act and that states that the goods that are the subject of a verification of origin are not eligible for preferential tariff treatment under the CPAFTA.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-14" lims:fid="827934" lims:id="827934"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827935" lims:id="827935">Notice’s</MarginalNote><Label>(2)</Label><Text>The written notice must specify the date from which preferential tariff treatment under the CPAFTA may be denied or withdrawn in respect of the goods that are the subject of the verification of origin and the period during which the exporter or producer of the goods may provide written comments or additional information regarding the origin of those goods.</Text></Subsection></Section><Heading lims:inforce-start-date="2016-06-14" lims:fid="827936" lims:id="827936" level="1"><TitleText>Communication</TitleText></Heading><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827937" lims:id="827937"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827938" lims:id="827938">Means of communication</MarginalNote><Label>11</Label><Text>A verification letter, a verification questionnaire and the notices referred to in paragraph 6(1)(a) and section 10 must be sent by any means that produces confirmation of receipt.</Text></Section><Heading lims:inforce-start-date="2016-06-14" lims:fid="827939" lims:id="827939" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2016-06-14" lims:lastAmendedDate="2016-06-14" lims:fid="827940" lims:id="827940"><MarginalNote lims:inforce-start-date="2016-06-14" lims:fid="827941" lims:id="827941">April 1, 2013</MarginalNote><Label>12</Label><Text>These Regulations are deemed to have come into force on April 1, 2013.</Text></Section></Body></Regulation>
