lims:id="957747"><Label>(a)</Label><Text>to fishing equipment despite deterrence efforts, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957748" lims:id="957748"><Label>(b)</Label><Text>based on a scientific recommendation, to the conservation of anadromous or catadromous fish stocks because it inflicts great damage to them along estuaries and in rivers and lakes during the migration of those species; (<DefinedTermFr>phoque nuisible</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-06-22" in these Regulations to a species or group of species of marine mammals by its common name as set out in column I of an item of Schedule I shall be construed as a reference to the species or group of species whose scientific name is set out in column II of that item.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957755" lims:id="957755"><Label>(3)</Label><Text>In these Regulations, all geographical coordinates (latitude and longitude) are expressed in the North American Datum 1927 (NAD 27) geodetic reference system.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957756" lims:id="957756"><Label>(4)</Label><Text>In these Regulations, the lines connecting points or coordinates are rhumb lines, unless stated management and control of fishing for marine mammals and related activities in Canada and in Canadian fisheries waters;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957762" lims:id="957762"><Label>(b)</Label><Text>the management and control of fishing for marine mammals from Canadian fishing vessels in the Antarctic; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957763" lims:id="957763"><Label>(c)</Label><Text>the conservation and protection of marine mammals in Canada and in Canadian fisheries waters.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-06-22" lims:fid="957765" lims:id="957765">SOR/2018-126, s. paragraph 3(a), these Regulations do not apply to fishing for marine mammals that is authorized by an aquaculture licence issued under the <XRefExternal reference-type="regulation" the event of any inconsistency between these Regulations and any regulations respecting marine mammals made under the Oceans Act, the <XRefExternal reference-type="act" link="S-1.3">Saguenay-St. Lawrence Marine Park Act</XRefExternal> or the <XRefExternal reference-type="act" link="C-7.3">Canada National Marine Conservation Areas Act</XRefExternal>, the regulations made under those Acts shall and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957799" lims:id="957799"><Label>(c)</Label><Text>subject to section 26, four walrus in a year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="957800" lims:id="957800"><Label>(3)</Label><Text>A person, other than a person referred to in subsection (1) or (2), who resides immediately adjacent to any of Sealing Areas 1 to 4 may fish for seals without a licence in any of those Sealing Areas for food purposes.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-06-22" lims:fid="957801" lims:id="957801" level="2"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2018-06-22" lims:lastAmendedDate="2018-06-22" lims:fid="957802" lims:id="957802"><Label>7</Label><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957803" lims:id="957803"><Label>(1)</Label><Text>No person shall disturb a marine mammal except</Text><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957804" lims:id="957804"><Label>(a)</Label><Text>when carrying on a work, undertaking or activity that is authorized, otherwise permitted or required under the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957805" lims:id="957805"><Label>(b)</Label><Text>when fishing for marine mammals under the authority of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957806" lims:id="957806"><Label>(c)</Label><Text>in the manner set out in a licence issued under the <XRefExternal reference-type="regulation" link="SOR-93-53">Fishery (General) Regulations</XRefExternal> authorizing them to fish for marine mammals for experimental, scientific, educational or public display purposes; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957807" lims:id="957807"><Label>(d)</Label><Text>in the manner authorized under the <XRefExternal reference-type="act" link="S-15.3">Species at Risk Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957808" lims:id="957808"><Label>(2)</Label><Text>For the purposes of subsection (1), <DefinitionRef>disturb</DefinitionRef> includes to approach the marine mammal to, or to attempt to,</Text><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957809" lims:id="957809"><Label>(a)</Label><Text>feed it;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957810" lims:id="957810"><Label>(b)</Label><Text>swim with it or interact with it;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957811" lims:id="957811"><Label>(c)</Label><Text>move it or entice or cause it to move from the immediate vicinity in which it is found;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957812" lims:id="957812"><Label>(d)</Label><Text>separate it from members of its group or go between it and a calf;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957813" lims:id="957813"><Label>(e)</Label><Text>trap it or its group between a vessel and the shore or between a vessel and one or more other vessels; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957814" lims:id="957814"><Label>(f)</Label><Text>tag or mark it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957815" lims:id="957815"><Label>(3)</Label><Text>For the purposes of subsection (1), in the case of a marine mammal that is of a species set out in column 1 of Schedule VI, <DefinitionRef>disturb</DefinitionRef> also includes to approach the marine mammal with a vehicle of the type set out in column 2 within the approach distance set out in column 3 in the area set out in column 4 during the period set out in column 5.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957816" lims:id="957816"><Label>(4)</Label><Text>For the purposes of subsection (1), in the case of a whale, dolphin or porpoise in resting position or with its calf, <DefinitionRef>disturb</DefinitionRef> also includes to approach the whale, dolphin or porpoise with a vehicle of the type set out in column 2 of Schedule VI, at an approach distance of less than 200 m in all Canadian fisheries waters from January 1 to December 31.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="957817" lims:id="957817"><Label>(5)</Label><Text>The requirement to respect the approach distances set out in Schedule VI and in subsection (4) does not apply to</Text><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957818" lims:id="957818"><Label>(a)</Label><Text>a vessel that is in transit; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957819" lims:id="957819"><Label>(b)</Label><Text>the holder of a seal fishery observation licence who is observing the seal fishery.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-06-22" lims:fid="957821" lims:id="957821">SOR/2018-126, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-06-22" lims:lastAmendedDate="2018-06-22" lims:fid="957822" lims:id="957822"><Label>7.1</Label><Text>The prohibition set out in section 7 does not apply to</Text><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957823" lims:id="957823"><Label>(a)</Label><Text>employees of the Department who are performing their duties or functions or persons who are assisting them or who are otherwise present at the request of the Department; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957824" lims:id="957824"><Label>(b)</Label><Text>employees of the Parks Canada Agency or the Department of National Defence, members of the Canadian Forces and peace officers, while they are performing their 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-11-02" lims:lastAmendedDate="2018-11-02" lims:fid="957827" lims:id="957827"><Label>7.2</Label><Subsection lims:inforce-start-date="2018-11-02" lims:fid="957828" lims:id="957828"><Label>(1)</Label><Text>When an aircraft is being operated at an altitude of less than 304.8 m (1,000 ft.) within a radius of one-half nautical mile from a marine mammal, no person shall perform a flight manoeuvre — including taking off, landing or altering the course or altitude of the aircraft — for the purpose of bringing the aircraft closer to the marine mammal or otherwise disturbing it.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-02" lims:fid="957829" lims:id="957829"><Label>(2)</Label><Text>Subsection (1) does not apply</Text><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="957830" lims:id="957830"><Label>(a)</Label><Text>to the holder of a licence that is issued under the <XRefExternal reference-type="regulation" link="SOR-93-53">Fishery (General) Regulations</XRefExternal> and that authorizes fishing for marine mammals for experimental, scientific, educational or public display purposes, when the holder is conducting activities authorized by the licence;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="957831" lims:id="957831"><Label>(b)</Label><Text>to employees of the Department who are performing their duties or functions or person who are assisting them or who are otherwise present at the request of the Department;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="957832" lims:id="957832"><Label>(c)</Label><Text>to employees of the Parks Canada Agency or the Department of National Defence, members of the Canadian Forces and peace officers, who are performing their duties or functions;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="957833" lims:id="957833"><Label>(d)</Label><Text>to a commercial flight that is operating on a scheduled flight plan; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-02" lims:fid="957834" lims:id="957834"><Label>(e)</Label><Text>to a helicopter that is being used for seal pup observation on the ice of the waters of the Gulf of St. Lawrence, if it maintains a distance of at least two metres from the seal pups.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-02" lims:fid="957835" lims:id="957835"><Label>(3)</Label><Text>Despite subsection (1), the holder of a seal fishery observation licence is permitted to take off or land an aircraft within a radius of one-half nautical mile from a marine mammal for the purpose of conducting activities authorized by the licence.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-02" lims:fid="957837" lims:id="957837">SOR/2018-126, s. 6; SOR/2018-229, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957838" lims:id="957838"><Label>8</Label><Text>No person shall attempt to kill a marine mammal except in a manner that is designed to kill it quickly.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957839" lims:id="957839"><Label>9</Label><Text>No person shall fish for a marine mammal without having on hand the equipment that is necessary to retrieve it.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957840" lims:id="957840"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="957841" lims:id="957841"><Label>(1)</Label><Text>No person who kills or wounds a marine mammal shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957842" lims:id="957842"><Label>(a)</Label><Text>fail to make a reasonable effort to retrieve it without delay; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957843" lims:id="957843"><Label>(b)</Label><Text>subject to section 33.1, abandon or discard it.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="957844" lims:id="957844"><Label>(2)</Label><Text>No person who kills a cetacean or walrus shall waste any edible part of it.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="957846" lims:id="957846">SOR/2003-103, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-06-22" lims:lastAmendedDate="2018-06-22" lims:fid="957847" lims:id="957847"><Label>11</Label><Text><Repealed>[Repealed, SOR/2018-126, s. 7]</Repealed></Text></Section><Heading lims:inforce-start-date="2018-06-22" lims:fid="957848" lims:id="957848" level="2"><TitleText>Notice that Fishing Quota has been Reached</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957849" lims:id="957849"><Label>12</Label><Text>Where an annual fishing quota fixed by these Regulations has been reached, a fishery officer shall notify the persons affected or likely to be affected by one or more of the methods set out in subsection 7(1) of the <XRefExternal reference-type="regulation" link="SOR-93-53">Fishery (General) Regulations</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2018-06-22" lims:fid="957850" lims:id="957850" level="2"><TitleText>Sale and Transportation</TitleText></Heading><Section lims:inforce-start-date="2018-05-30" lims:lastAmendedDate="2018-05-30" lims:fid="957851" lims:id="957851"><Label>13</Label><Subsection lims:inforce-start-date="2018-05-30" lims:fid="957852" lims:id="957852"><Label>(1)</Label><Text>Subject to subsection (2), no person shall buy, sell, trade or barter the edible parts of a cetacean or walrus.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="957853" lims:id="957853"><Label>(2)</Label><Text>Subsection (1) does not apply in respect of buying, selling, trading or bartering by</Text><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="957854" lims:id="957854"><Label>(a)</Label><Text>an Indian or Inuk, other than a beneficiary, within the Northwest Territories, Yukon, Quebec or Newfoundland and Labrador; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="957855" lims:id="957855"><Label>(b)</Label><Text>a beneficiary, if the purchase, sale, trade or barter is carried out in accordance with the terms of the agreement under which the beneficiary is enrolled.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-05-30" lims:fid="957857" lims:id="957857">SOR/2018-110, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957858" lims:id="957858"><Label>14</Label><Text>No person shall buy, sell, trade, barter or possess a narwhal tusk unless the licence under the authority of which the narwhal was taken is attached to the tusk.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957859" lims:id="957859"><Label>15</Label><Text>The Minister shall, on application, issue a marine mammal transportation licence</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957860" lims:id="957860"><Label>(a)</Label><Text>authorizing a person to take or carry edible marine mammal parts from one province to another for the personal use of that person or the members of that person’s family;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957861" lims:id="957861"><Label>(b)</Label><Text>in respect of non-edible marine mammal parts; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957862" lims:id="957862"><Label>(c)</Label><Text>in respect of any marine mammal or marine mammal parts to be used for experimental, scientific, educational or public display purposes.</Text></Paragraph></Section><Section lims:inforce-start-date="2018-05-30" lims:lastAmendedDate="2018-05-30" lims:fid="957863" lims:id="957863"><Label>16</Label><Subsection lims:inforce-start-date="2018-05-30" lims:fid="957864" lims:id="957864"><Label>(1)</Label><Text>Subject to subsection (2), no person shall take or carry marine mammals or marine mammal parts from one province to another except under the authority of a marine mammal transportation licence issued by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="957865" lims:id="957865"><Label>(2)</Label><Text>Subsection (1) does not apply</Text><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="957866" lims:id="957866"><Label>(a)</Label><Text>to a person who fishes for marine mammals in one province and resides in another province and who is taking or carrying his catch to his place of residence;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="957867" lims:id="957867"><Label>(b)</Label><Text>in respect of seals or seal parts taken from any of Sealing Areas 4 to 33; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="957868" lims:id="957868"><Label>(c)</Label><Text>to a beneficiary who is transporting any marine mammal or marine mammal parts in accordance with the Agreement referred to in paragraph (c) of the definition <DefinitionRef>beneficiary</DefinitionRef>.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-05-30" lims:fid="957870" lims:id="957870">SOR/2018-110, Reporting</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957872" lims:id="957872"><Label>17</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="957873" lims:id="957873"><Label>(1)</Label><Text>Every person who is authorized under these Regulations to fish for cetaceans or walrus shall keep a record for a period of two years of any cetacean or walrus taken and shall produce that record for examination when requested to do so by a fishery officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="957874" lims:id="957874"><Label>(2)</Label><Text>The record referred to in subsection (1) shall contain the time and place at which the cetacean or walrus was taken and the species, sex and colour of the cetacean or walrus.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-06-22" lims:fid="957875" lims:id="957875" level="1"><Label>PART II</Label><TitleText>Cetaceans</TitleText></Heading><Heading lims:inforce-start-date="2018-06-22" lims:fid="957876" lims:id="957876" level="2"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957877" lims:id="957877"><Label>17.1</Label><Text>In this Part, <DefinedTermEn>strike</DefinedTermEn> means to wound a cetacean but be unable to retrieve it from the water.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="957879" lims:id="957879">SOR/2003-103, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957880" lims:id="957880"><Label>18</Label><Text>No person shall fish for a beluga calf, bowhead calf or narwhal calf or for an adult beluga, bowhead whale or narwhal that is accompanied by a calf.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957881" lims:id="957881"><Label>19</Label><Text>No person shall fish for cetaceans with a firearm unless the person uses</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957882" lims:id="957882"><Label>(a)</Label><Text>a rifle and bullets that are not full metal-jacketed that produce a muzzle energy of not less than 1,500 foot pounds; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957883" lims:id="957883"><Label>(b)</Label><Text>a shotgun and rifled slugs that produce a muzzle energy of not less than 1,500 foot pounds.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-06-22" lims:fid="957884" lims:id="957884" level="2"><TitleText>Beluga</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957885" lims:id="957885"><Label>20</Label><Text>No person shall fish for beluga in the St. Lawrence River, the Saguenay River or any of their tributaries or in the Gulf of St. Lawrence.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="957886" lims:id="957886"><Label>21</Label><Text>No person shall fish for beluga in an area described in column I of an item of Schedule II</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957887" lims:id="957887"><Label>(a)</Label><Text>during the close time set out in column II of that item; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957888" lims:id="957888"><Label>(b)</Label><Text>after notice has been given by a fishery officer that the annual fishing quota set out in column III of that item has been reached.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-06-22" lims:fid="957889" lims:id="957889" level="2"><TitleText>Bowhead Whales</TitleText></Heading><Section lims:inforce-start-date="2008-04-03" lims:lastAmendedDate="2008-04-03" lims:fid="957890" lims:id="957890"><Label>22</Label><Text>No person shall fish for bowhead whales in the waters described in column I of an item of the table to this section</Text><Paragraph lims:inforce-start-date="2008-04-03" lims:fid="957891" lims:id="957891"><Label>(a)</Label><Text>during the close time set out in column II of that item; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-03" lims:fid="957892" of the licence indicated on the licence, mark on that portion of the licence the month in which the narwhal was killed and the sex of the narwhal, and return that portion of the licence as soon as lims:id="957927"><Label>(1)</Label><Text>Every person who fishes for seals shall hold at least one of the following licences:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957928" lims:id="957928"><Label>(a)</Label><Text>a fishing licence for seal — personal use;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957929" lims:id="957929"><Label>(b)</Label><Text>a fishing licence for seal — commercial use; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="957930" lims:id="957930"><Label>(c)</Label><Text>a fishing licence for nuisance seal.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="957931" lims:id="957931"><Label>(2)</Label><Text>The operator of a collector vessel shall hold a collector vessel licence.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="957933" lims:id="957933">SOR/2003-103, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-02-28" lims:id="957938"><Label>27</Label><Text>No person other than a beneficiary shall sell, trade or barter a whitecoat or blueback.</Text></Section><Section lims:inforce-start-date="2009-02-12" lims:lastAmendedDate="2009-02-12" lims:fid="957939" lims:id="957939"><Label>28</Label><Subsection lims:inforce-start-date="2009-02-12" lims:fid="957940" lims:id="957940"><Label>(1)</Label><Text>No person shall fish for seals, for personal or commercial use, in any of Sealing Areas 4 to 33 except with</Text><Paragraph lims:inforce-start-date="2009-02-12" lims:fid="957941" lims:id="957941"><Label>(a)</Label><Text>a round club made of hardwood that measures not less than 60 cm and not more than 1 m in length and that, for at least half of its length, beginning at one end, measures not less than 5 cm and not more than 7.6 cm in diameter;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-12" lims:fid="957942" lims:id="957942"><Label>(b)</Label><Text>an instrument known as a hakapik, consisting of a metal ferrule that weighs at least 340 g with a slightly bent spike not more than 14 cm in length on one side of the ferrule and a blunt projection not more than 1.3 cm in length on the opposite side of the ferrule and that is attached to a wooden handle that measures not less than 105 cm and not more than 153 cm in length and not less than 3 cm and not more than 5.1 cm in diameter;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-12" lims:fid="957943" lims:id="957943"><Label>(c)</Label><Text>a rifle and bullets that are not full metal-jacketed that produce a muzzle velocity of not less than 1,800 feet per second and a muzzle energy of not less than 1,100 foot pounds; or</Text></Paragraph><Paragraph lims:inforce-start-date="2009-02-12" lims:fid="957944" lims:id="957944"><Label>(d)</Label><Text>a shotgun of not less than 20 gauge and rifled slugs.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-02-12" lims:fid="957945" lims:id="957945"><Label>(1.1)</Label><Text>No person shall use a club or hakapik to strike a seal older than one year unless the seal has been shot with a firearm.</Text></Subsection><Subsection lims:inforce-start-date="2009-02-12" lims:fid="957946" lims:id="957946"><Label>(2)</Label><Text>Every person who strikes a seal with a club or hakapik shall strike the seal on the top of the cranium until it has been crushed and shall immediately palpate the cranium to confirm that it has been crushed.</Text></Subsection><Subsection lims:inforce-start-date="2009-02-12" lims:fid="957947" lims:id="957947"><Label>(3)</Label><Text>If a firearm is used to fish for a seal, the person who shoots the seal or retrieves it shall palpate the cranium as soon as possible after it is shot to confirm that the cranium has been crushed.</Text></Subsection><Subsection lims:inforce-start-date="2009-02-12" lims:fid="957948" lims:id="957948"><Label>(4)</Label><Text>Every person who palpates the cranium of a seal and determines that the cranium is not crushed shall immediately strike the seal with a club or hakapik on the top of its cranium until the cranium has been crushed.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-02-12" lims:fid="957950" lims:id="957950">SOR/2003-103, lims:inforce-start-date="2018-06-22" lims:fid="957956" lims:id="957956" level="2"><TitleText>Observation of Seal Fisheries</TitleText></Heading><Section lims:inforce-start-date="2015-07-16" lims:lastAmendedDate="2015-07-16" lims:fid="957957" lims:id="957957"><Label>32</Label><Subsection lims:inforce-start-date="2015-07-16" lims:fid="957958" lims:id="957958"><Label>(1)</Label><Text>A seal fishery observation licence may be issued only if the Minister determines that the issuance of the licence will not cause disruption to a seal fishery.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-16" lims:fid="957959" lims:id="957959"><Label>(2)</Label><Text>For the purposes of subsection (1), the Minister, in determining whether the issuance of a seal fishery observation licence will cause disruption to a seal fishery in a specific geographical area, shall consider</Text><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="957960" lims:id="957960"><Label>(a)</Label><Text>the period and geographical area for which the licence is being sought;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="957961" lims:id="957961"><Label>(b)</Label><Text>the number of seal fishery observation licences previously issued for that period in that area;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="957962" lims:id="957962"><Label>(c)</Label><Text>the number of seal hunters operating in that area;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="957963" lims:id="957963"><Label>(d)</Label><Text>whether the applicant has a stated aim of disrupting the seal fishery or has been convicted, in the five years preceding the application for the licence, of tagging, marking or moving a live seal, of contravening subsection 33(1) or of violating a condition of a seal fishery observation licence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="957964" lims:id="957964"><Label>(e)</Label><Text>any other relevant lims:id="957970"><Label>(a)</Label><Text>to a person who is authorized to fish for seals under these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957971" lims:id="957971"><Label>(b)</Label><Text>in respect of commercial flights that are operating on scheduled flight plans;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957972" lims:id="957972"><Label>(c)</Label><Text>in respect of commercial vessels that are in transit;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957973" lims:id="957973"><Label>(d)</Label><Text>to employees of the Department who are performing their duties or functions or persons who are assisting them or who are otherwise present at the request of the Department; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="957974" lims:id="957974"><Label>(e)</Label><Text>to a person who resides on land within one nautical mile Subarea set out in column II with a class of fishing licence for seal set out in column III during the close time set out in column IV.</Text></Subsection><Subsection out in column I of Schedule V in a Sealing Area or Subarea set out in column II during the close time set out in column III.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="957990" lims:id="957990"><Label>(2)</Label><Text>For the purpose of subsection (1), a close time set out in column III of Schedule V is deemed to be fixed in respect of each Sealing Area or lims:id="958017"><Label>(a)</Label><Text>could benefit marine mammals without jeopardizing the survival of the species in the wild;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958018" lims:id="958018"><Label>(b)</Label><Text>could improve a marine mammal’s immediate chance of survival;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958019" lims:id="958019"><Label>(c)</Label><Text>would contribute to the conservation and protection of marine mammals;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958020" lims:id="958020"><Label>(d)</Label><Text>could ease the pain and suffering of a marine mammal that is in distress;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958021" lims:id="958021"><Label>(e)</Label><Text>would contribute to marine scientific research; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958022" lims:id="958022"><Label>(f)</Label><Text>would permit the production of audiovisual records of activities of marine mammals, which could facilitate a better understanding of marine mammals and thereby contribute to their conservation and protection.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-22" lims:fid="958023" lims:id="958023"><Label>(2)</Label><Text>The authorization may be subject to any condition respecting</Text><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958024" lims:id="958024"><Label>(a)</Label><Text>the waters in which marine mammals may be disturbed;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958025" lims:id="958025"><Label>(b)</Label><Text>the marine mammals that may be disturbed;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958026" lims:id="958026"><Label>(c)</Label><Text>the period during which marine mammals may be disturbed;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958027" lims:id="958027"><Label>(d)</Label><Text>the type, size, number and identification of vehicles that are permitted to be used and the persons who are permitted to operate them;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958028" lims:id="958028"><Label>(e)</Label><Text>the manner in which those vehicles are to be operated, including the distance they are required to maintain from marine mammals, their speed and direction and the requirement to avoid impeding the path of marine mammals;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958029" lims:id="958029"><Label>(f)</Label><Text>the manner in which marine mammals may be disturbed and the measures that are required to mitigate or minimize the negative effects of disturbing them;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958030" lims:id="958030"><Label>(g)</Label><Text>the diagnostic assessment or any other assessments that are to be carried out in respect of marine mammals before, during and after the disturbance;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958031" lims:id="958031"><Label>(h)</Label><Text>the information that must be reported to the Minister, as well as the method by which, the times at which and the person for whom the report is to be made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958032" lims:id="958032"><Label>(i)</Label><Text>the records that must be maintained with respect to the activity causing the disturbance as well as the manner and form in which the records are to be maintained, the times at which and the person for whom the records are to be produced and the period for which the records are to be lims:inforce-start-date="2018-06-22" lims:fid="958040" lims:id="958040"><Label>(d)</Label><Text>the size and type of vehicle and, if applicable, the type of fishing gear involved in the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958041" lims:id="958041"><Label>(e)</Label><Text>the weather and sea conditions at the time of the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-06-22" lims:fid="958042" lims:id="958042"><Label>(f)</Label><Text>the observed state of the marine mammal after the incident;
